1. Agreement to these Terms
These Terms of Service ("Terms") form a binding contract between you and Foodmap, LLC, a Delaware limited liability company with its principal place of business at 2614 4th Street, Santa Monica, California 90405 ("Foodmap," "we," "us," "our"). They govern your access to and use of www.foodmap.build, the maps we host at foodmap.build/m/…, and all related features, software and services (together, the "Service").
By creating an account, building or editing a map, viewing a map we host, or purchasing a plan, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
⚖️ PLEASE READ SECTION 20. It requires most disputes between you and us to be resolved by individual binding arbitration and waives your right to participate in a class action. You may opt out within 30 days of first accepting these Terms.
2. Eligibility
You must be at least 18 years old to create an account or purchase a plan. The Service is not directed to children, and we do not knowingly collect personal information from anyone under 13. If you use the Service on behalf of an organisation, you represent that you are authorised to bind it, and "you" means that organisation.
3. Accounts and sign-in
We sign you in by sending a link and a short code to your email address. Anyone with access to your email inbox can sign in to your account, so keep your inbox secure. You are responsible for all activity under your account.
Accounts are personal to you and may not be shared, sold or transferred. Tell us promptly at support@foodmap.build if you believe your account has been accessed without your permission. We may decline to create, may suspend, or may reclaim an account that is inactive, duplicative, or used in breach of these Terms.
4. What Foodmap is — and what it is not
Foodmap collects recommendations that third-party publications have already published, resolves them to real venues, organises them, and renders them as a map you can open, share and edit.
We are independent. We are not affiliated with, endorsed, sponsored or approved by any publication, guide, award programme, restaurant, bar or other venue referred to in the Service. Publication names, guide names, award names and trademarks are the property of their respective owners and are used only to identify the source of a recommendation. Where we display an article headline, it is displayed solely as a link to the publisher's own page, so that you can read the original there.
Publishers: if you own or represent a publication cited in the Service and wish to discuss how your material is referenced, or to request removal, write to legal@foodmap.build and we will respond promptly.
Venue information may be wrong. Venue details are compiled from third-party sources — including mapping data providers and published articles — and the descriptive text shown for each venue is generated automatically using artificial intelligence. Information may be inaccurate, incomplete, outdated or mistakenly attributed. Venues close, move, change hours, change ownership and change menus without notice.
Do not rely on the Service for anything that matters. You must not rely on the Service for information about allergens, ingredients, dietary suitability, accessibility, health, safety, legality, opening hours or pricing. Always confirm directly with the venue. Your travel, dining and route decisions, and your use of any location shown on a map, are entirely at your own risk.
Coverage and currency
We aim to cover the publications we name, but we do not promise complete coverage, and we do not promise any particular speed of updating.
We do not represent or warrant that every venue recommended by a publication we cite appears in the Service, or that any particular venue, article, list, edition, city or country is included. A venue may be absent for many reasons — because no mapping listing exists for it, because it could not be reliably matched to a physical location, because our quality checks excluded it, or because we have not yet processed the article in which it appears.
We do not commit to any timeframe for adding newly published recommendations, for reflecting a new edition of a guide or list, or for removing venues that have closed or lost a distinction. The publications and lists we draw on may change at any time: a source available today may be reduced, suspended or removed, and we may add others.
Any category, ranking, niche or “new” designation shown in the Service is our own editorial and automated judgment. It is not a statement by, and should not be attributed to, any publication we cite.
The absence of a venue you expected, the presence of one you would not have chosen, and the staleness of any listing are inherent in a service of this kind and are not defects in the Service.
5. Early access; changes to the Service
The Service is in early access. Features may be added, changed, disabled or removed at any time, including features referenced in marketing or documentation. We may impose or change limits on builds, map sizes, layers, map views and other resources. We will try to give reasonable notice of changes that materially reduce functionality you have paid for, but we do not guarantee that any particular feature or any particular map will remain available.
6. Plans, previews and payment
6.1 Free preview
Without a subscription, you may build a map as a free preview. A preview map is live for 60 minutes from the moment it is built. After 60 minutes it disappears from your shelf and its link returns an expiry page.
If you subscribe while the preview is still live, that map is converted into a permanent map in your account. If you subscribe after it has expired, it is not restored and you will need to build again. The number, scope and availability of free previews may change at any time.
6.2 Foodmap Monthly
Paid access is Foodmap Monthly at US$10 per month, plus applicable taxes. Payments are processed by Stripe; we never receive or store your full card number.
6.3 Automatic renewal — please read
Your subscription renews automatically. You are charged US$10 when you subscribe, and your subscription then renews monthly on the same day of the month that you subscribed — if you subscribe on the 20th, you are charged on the 20th of each following month — until you cancel. Each renewal is charged to the payment method on file at the then-current price.
You may cancel at any time, online and immediately, at www.foodmap.build/account by selecting Manage or cancel subscription, which opens the Stripe billing portal where you can cancel. You may also email support@foodmap.build.
Cancellation takes effect at the end of the period you have already paid for, and you keep full access until then. If you subscribe on the 20th and cancel on the 22nd, you keep access until the 20th of the following month and are not charged again. To avoid the next charge, cancel before your renewal date.
6.4 Access codes
Access codes are single-use, have no cash value, and may be limited to a particular destination or plan and may expire. Where more than one code is available on your account, we will use the least flexible and soonest-expiring code first, so that a more flexible code is preserved. If a build fails terminally through no fault of yours, we will restore the code used for it. Codes may not be resold or offered commercially.
6.5 Price changes
We may change prices. We will give you at least 30 days' notice by email before a price change applies to your subscription, and the new price will take effect at the start of the next billing period. If you do not accept the change, cancel before it takes effect.
6.6 Taxes
Prices are exclusive of sales, use, VAT, GST and similar taxes, which we will add where required.
6.7 Refunds
Except as set out in these Terms or required by law, all charges are final and non-refundable, including for partial months and for maps you do not use. This does not affect any statutory rights you have as a consumer. Except where required by law, the absence of a particular venue, publication, city or article from a map you build is not a failure of the Service and is not a ground for a refund.
6.8 Consumers in the EEA and UK — right of withdrawal
Digital services are supplied immediately. By purchasing, you expressly request that we begin supplying the Service immediately and acknowledge that you will lose your 14-day right of withdrawal once supply has begun.
6.9 Failed payments
If a payment fails, we may retry, suspend paid features, or cancel your subscription. You remain liable for amounts owed.
7. Usage limits and fair use
A subscriber account may hold up to 100 saved maps, including maps in your Deleted section. Preview maps do not count toward that limit. Hosted maps are subject to per-map monthly view limits and to overall capacity limits. We may apply rate limits, queue builds, cap map sizes, or temporarily restrict access to protect the Service and other users. Sustained automated or abnormal usage may be throttled or blocked.
8. Your content
"Your Content" means anything you create or add in the Service — map titles, edits, notes, added or removed places, and messages you send us.
You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt (for formatting and display), publish and transmit Your Content for the purpose of operating, securing and improving the Service, including displaying it to anyone holding a link to your map. This licence ends when you delete Your Content or your account, except for copies retained in routine backups and where we must retain it by law.
You represent that you have the rights to Your Content and that it is not unlawful, infringing, defamatory, deceptive, or in breach of anyone's privacy. We may remove content that breaches these Terms.
9. Sharing and publicly accessible maps
A hosted map is reachable at an unguessable link. Anyone who has that link can view the map without signing in. Treat a map link as public: do not include home addresses, private notes about identifiable people, or anything else you would not publish. We do not publish map links or submit them to search engines, but we cannot prevent a recipient from sharing a link, or a crawler from following one that has been posted publicly.
10. Our intellectual property
The Service — including our software, the venue and citation database and its structure, our category taxonomy and ranking logic, our generated descriptions, map layers and pin artwork, and the selection, arrangement and compilation of all of it — is owned by us or our licensors and is protected by copyright, database rights (including the sui generis database right in the EEA and UK), trade secret, trademark and other laws.
Subject to these Terms and your payment of applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service and the maps you build for your own personal, non-commercial use and to share them with people you choose. All rights not expressly granted are reserved.
11. Restrictions
You must not, and must not permit anyone else to:
scrape, crawl, spider, harvest, bulk-download, or systematically extract or re-utilise any part of the Service or of the venue, citation, category or ranking data it contains;
access the Service by any automated means, or through any interface other than the one we provide, except as we expressly permit in writing;
use the Service or any data obtained from it to build, train, populate or improve a competing or substantially similar dataset, product or service, or any machine-learning model;
reverse engineer, decompile or disassemble any part of the Service, or attempt to derive our taxonomy, ranking logic or source weightings, except to the extent this restriction is unenforceable under applicable law;
circumvent or attempt to circumvent any sign-in requirement, entitlement check, view cap, build limit, rate limit, preview expiry or other technical restriction;
resell, sublicense, rent or commercially exploit the Service, access codes, or maps built with it;
remove, obscure or alter any attribution, citation, copyright, trademark or other notice, including any mapping-provider attribution;
probe, scan or test the vulnerability of the Service, or breach or circumvent any security or authentication measure;
use the Service to store or transmit unlawful, infringing, harassing or deceptive material, or to impersonate any person or publication; or
use the Service in any way that violates applicable law or any third party's rights.
12. Third-party services and content
Google Maps. The Service uses Google Maps. By using the Service you agree to be bound by the Google Maps/Google Earth Additional Terms of Service, including the Google Privacy Policy.
Payments. Payments are handled by Stripe and are subject to Stripe's own terms and privacy policy.
Third-party links and articles. The Service links to articles and websites we do not control. We are not responsible for their content, availability, accuracy or practices, and a link is not an endorsement. Some linked publishers require a subscription to read their material; that relationship is between you and them.
13. Feedback
If you send us suggestions, ideas or feedback, we may use them without restriction, obligation or compensation to you. You grant us a perpetual, irrevocable, worldwide, royalty-free licence to use and exploit that feedback for any purpose.
14. Non-public features and confidentiality
If we give you access to a feature that is not generally available, or share non-public information about how the Service works, its roadmap, or its performance, you agree to keep that information confidential and not to disclose, publish or demonstrate it to anyone until we make it public. This does not apply to information that is or becomes public through no fault of yours, that you already lawfully had, or that you independently developed. This obligation survives for three (3) years after disclosure.
15. Suspension and termination
We may suspend or terminate your access, with or without notice, if you breach these Terms, if we reasonably suspect fraud or misuse, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends, hosted maps associated with your account may become unavailable or be deleted, and no refund is due except as required by law or expressly stated here.
You may stop using the Service at any time. To delete your account, email support@foodmap.build from the address on your account. Cancel any subscription first at www.foodmap.build/account, or ask us to cancel it in the same email.
Sections 8 (as to the licence for retained copies), 10, 11, 13, 14, and 16–22 survive termination.
16. Copyright complaints
If you believe material on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent, registered with the United States Copyright Office:

Your notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the material claimed to be infringing and information sufficient to locate it (a map URL and place name); (d) your contact details; (e) a statement that you have a good-faith belief the use is not authorised by the owner, its agent or the law; and (f) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act on the owner's behalf.
We will respond to valid notices, may remove or disable access to the material, and will notify the affected user, who may submit a counter-notice under 17 U.S.C. §512(g). We terminate the accounts of repeat infringers in appropriate circumstances.
17. Disclaimers
THE SERVICE, INCLUDING ALL VENUE DATA, CITATIONS, CATEGORIES, RANKINGS, GENERATED DESCRIPTIONS, COORDINATES AND MAPS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY AS TO ACCURACY, COMPLETENESS, CURRENCY, RELIABILITY OR UNINTERRUPTED OR ERROR-FREE OPERATION.
WE DO NOT WARRANT THAT ANY VENUE EXISTS, IS OPEN, IS CORRECTLY LOCATED, IS CORRECTLY CATEGORISED, OR WAS ACTUALLY RECOMMENDED BY THE PUBLICATION CITED.
WE DO NOT WARRANT THAT THE SERVICE IS COMPLETE, COMPREHENSIVE OR CURRENT. WITHOUT LIMITING SECTION 4, WE MAKE NO WARRANTY AS TO THE PROPORTION OF ANY PUBLICATION’S RECOMMENDATIONS THAT APPEARS IN THE SERVICE, THE TIME WITHIN WHICH ANY RECOMMENDATION, NEW EDITION, CLOSURE OR CHANGE IS REFLECTED, OR THE CONTINUED AVAILABILITY OF ANY PUBLICATION, LIST, SOURCE OR VENUE. NO STATEMENT BY US OR BY ANY THIRD PARTY CREATES ANY WARRANTY NOT EXPRESSLY SET OUT IN THESE TERMS.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions our warranties are limited to the shortest period and narrowest scope permitted by law, and nothing here limits your non-excludable statutory consumer rights.
18. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
(a) NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, OR THE COST OF SUBSTITUTE SERVICES, WHETHER OR NOT FORESEEABLE AND WHATEVER THE THEORY OF LIABILITY.
(b) OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) US$100.
These limits do not apply to liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
19. Indemnity
You will indemnify, defend and hold harmless Foodmap, LLC and its members, managers, officers, employees and agents from any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) your use of the Service; (c) your breach of these Terms or of applicable law; or (d) your infringement of any third party's rights. We will notify you of any such claim and may assume its defence at your expense.
20. Disputes, arbitration and governing law
20.1 Informal resolution first
Before starting a formal proceeding, you agree to email legal@foodmap.build describing the dispute and the relief sought. The parties will try in good faith to resolve it for 60 days. This is a condition precedent to arbitration, and the limitations period is tolled during it.
20.2 Binding individual arbitration
If the dispute is not resolved, you and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures (and its Consumer Minimum Standards where applicable), before a single arbitrator. The arbitration will be seated in Los Angeles County, California or, at your election, conducted by telephone, videoconference, or on documents only. The Federal Arbitration Act governs this section.
20.3 Exceptions
Either party may (a) bring an individual claim in small claims court, and (b) seek injunctive or equitable relief in court to protect intellectual property or to stop unauthorised access to or extraction from the Service.
20.4 Class action waiver
Claims may be brought only in your or our individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or preside over any representative proceeding. If this waiver is held unenforceable as to a particular claim, that claim (and only that claim) must proceed in court under Section 20.7.
20.5 Batch arbitration
If 25 or more similar claims are asserted against us by or with the assistance of the same firm or coordinated group, the claims will be administered in batches of up to 50, with a single arbitrator and a single set of fees per batch, and the limitations period is tolled for claims awaiting their batch.
20.6 30-day opt-out
You may opt out of Sections 20.2–20.5 by emailing legal@foodmap.build with your name, the email address on your account, and a clear statement that you opt out of arbitration, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
20.7 Governing law and forum
These Terms are governed by the laws of the State of California, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Where Section 20.2 does not apply, the state and federal courts located in Los Angeles County, California have exclusive jurisdiction, and both parties consent to personal jurisdiction there.
20.8 Consumers outside the US
If you are a consumer resident in the EEA, the UK or another jurisdiction whose law gives you a non-waivable right to the protection of your local law or to bring proceedings in your local courts, nothing in this Section removes that right.
21. Changes to these Terms
We may update these Terms. We will post the updated version with a new "Last updated" date and, for material changes, give at least 30 days' notice by email or in the Service before they take effect. Continued use after the effective date means you accept the updated Terms. If you do not accept them, stop using the Service and cancel any subscription.
22. General
Entire agreement. These Terms and the Privacy Policy are the entire agreement between us about the Service and supersede any prior understanding. Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets. Severability. If any provision is unenforceable, it is modified to the minimum extent necessary or severed, and the rest remains in force. No waiver. A failure to enforce a provision is not a waiver of it. Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including third-party platform or API outages. Notices. We may give notice by email to the address on your account or by posting in the Service. Notices to us go to legal@foodmap.build. Export and sanctions. You represent that you are not located in, and are not a national of, a country or on a list subject to US embargo or sanctions, and that you will not use the Service in breach of export control laws. No third-party beneficiaries, except that Google is a third-party beneficiary of Section 12 as it relates to the Google Maps terms. Relationship. No agency, partnership, joint venture or employment is created.
